Bespoke Commission & Private Client Terms
1. About These Terms
1.1 These terms and conditions ("Terms") govern the provision of bespoke jewellery design and creation services, and the sale of jewellery, by Mona & Kimmo ("we", "us", "our") to our clients ("you", "your").
1.2 We operate on an appointment-only, private client basis. We do not sell products for immediate purchase through an online shop; every piece is discussed, designed and quoted for individually before any contract is formed.
1.3 You will be asked to give your express agreement to these Terms — normally by signing a written quotation or commission agreement — before any commission begins or deposit is taken.
1.4 These Terms do not affect your statutory rights as a consumer, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2. Interpretation
2.1 In these Terms, "Commission" means a bespoke piece of jewellery designed and made for you following a consultation; "Deposit" means the non-refundable sum payable to commence a Commission as described in Section 6; and "Design" means any sketch, CAD rendering, mock-up or specification produced for your Commission.
3. How a Commission Is Formed
3.1 Enquiries are made through our website, by email, or by telephone, and are followed by a private consultation (in person or virtually) to discuss your requirements, preferred materials, and budget.
3.2 Following consultation, we will provide a written quotation setting out the scope of the Commission, the materials to be used, the price, an estimated timeline, and the Deposit required. A quotation is not a binding offer and remains valid for the period stated on it (or, if none is stated, 14 days), after which prices may be revised to reflect current precious metal and gemstone costs.
3.3 No contract comes into existence, and no work will begin, until you have approved the written quotation and paid the Deposit in accordance with Section 6.
3.4 Where a Design is produced (sketch, CAD or mock-up), we will ask you to approve it in writing before production begins. Work will not proceed on the basis of a verbal approval alone.
4. Our Pieces
4.1 Every piece we make is bespoke and produced to your specification. We work principally in gold and platinum; we do not work in silver. Where gemstones are included, we will tell you what grading or certification (for example, GIA) applies, if any.
4.2 Because each Commission is handmade, minor variations from any Design, sketch or CAD rendering (for example, in stone placement, texture or finish) are an expected characteristic of bespoke work and not a defect.
4.3 Indicative pieces shown on our website or in our studio (including the Equals Ring) are shown as examples of our style and craftsmanship; your Commission will be made individually for you and will not be identical.
5. Prices
5.1 Prices quoted are specific to your Commission and reflect the materials, design complexity and gemstones agreed at the time of quotation. Prices are inclusive of VAT unless stated otherwise.
5.2 Precious metal and gemstone prices fluctuate. If there is a significant movement in the market price of gold, platinum or gemstones between quotation and the point at which materials are purchased, we will notify you before proceeding and agree any price adjustment with you in writing.
5.3 Any changes you request to an approved Design after work has begun may incur additional charges and affect the delivery timeline; we will agree these with you in writing before carrying them out.
6. Deposits and Payment
6.1 A non-refundable Deposit is required before we source materials or begin design work. The Deposit amount will be set out in your quotation and is typically 50% of the total price; for higher-value Commissions we may agree staged payments linked to key milestones (design approval, casting, setting, completion).
6.2 The Deposit is non-refundable once paid, reflecting the time, materials sourcing and design work committed to your Commission from that point, except where we are unable to fulfil the Commission for reasons within our control.
6.3 The balance of the price is due in full before your piece is released to you, whether by collection or delivery.
6.4 Payments may be made by any method we specify at the time. Section 6.5 below applies if you make an unjustified card charge-back.
6.5 If you make an unjustified charge-back in respect of an amount properly due to us, you will be liable, within 7 days of our written request, for: (a) the amount charged back; (b) any third-party fees we incur as a result; (c) an administration fee of £25 including VAT; and (d) our reasonable costs of recovering these amounts, including legal and debt collection fees.
7. Delivery and Collection
7.1 Completed pieces may be collected in person by appointment or delivered by fully insured courier, as agreed with you.
7.2 We will give you a realistic estimated completion date at quotation stage and will keep you updated on progress; bespoke work, particularly Commissions involving complex setting or sourcing of specific gemstones, can take longer than anticipated, and estimated dates are not guaranteed delivery dates.
7.3 Risk in the piece passes to you on collection or on delivery to the address you specify. We insure pieces in our possession and in transit up to the point risk passes to you.
8. Cancellation Rights for Bespoke Commissions
8.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day cancellation right for online and off-premises purchases does not apply to goods made to your specification or clearly personalised, which includes every Commission we undertake.
8.2 This means that once you have approved a quotation and paid your Deposit, you do not have a statutory right to cancel simply because you change your mind. We mention this clearly at quotation stage so there are no surprises later.
8.3 If you wish to cancel a Commission after work has begun, please contact us as soon as possible. We will confirm in writing what has already been spent on materials and work carried out, and: (a) your Deposit will not be refunded; and (b) if costs already incurred (for materials purchased or work done) exceed the Deposit, you will remain liable for the difference.
8.4 This Section 8 does not affect your right to a repair, replacement or refund under the Consumer Rights Act 2015 if a piece we deliver is faulty, not as described, or not of satisfactory quality - see Section 10.
9. Design Ownership and Confidentiality
9.1 You own the physical piece once paid for in full and collected or delivered. Unless we agree otherwise in writing, we retain ownership of the underlying Designs, sketches, CAD files and any bespoke techniques developed in creating your Commission, and may retain photographs of the finished piece for our portfolio unless you ask us not to.
9.2 We treat all client details, consultation notes and Commission specifications as confidential, and will not share them with third parties except where needed to fulfil your Commission (for example, with a gemstone supplier or valuer) or where we are required to by law.
10. Our Promise on Quality
10.1 We warrant that: (a) we have the right to sell you the piece; (b) it is sold free from any undisclosed charge or encumbrance; (c) it corresponds to the Design and specification you approved; and (d) it is of satisfactory quality, having regard to the fact that it is handmade and bespoke.
10.2 We provide a 12-month warranty against faults in workmanship or materials from the date of collection or delivery. This does not cover damage from accident, misuse, normal wear and tear, or alterations carried out by a third party.
10.3 As a Private Client, you are invited to bring your piece back to us at any time for aftercare, cleaning, resizing or repair; charges for aftercare outside the warranty period will be agreed with you before work begins.
10.4 Where requested, we can arrange an independent valuation of your piece for insurance purposes, at an additional cost agreed with you in advance.
11. Your Warranties to Us
11.1 You confirm that you are legally capable of entering into a binding contract, that any information you give us (including sizing and specification) is accurate, and that you will make yourself reasonably available for fittings and approvals needed to complete your Commission.
12. Limitation of Liability
12.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Your statutory rights as a consumer are not affected.
12.2 Subject to Section 12.1, our total liability to you in connection with a Commission is limited to the price paid for that Commission, and we are not liable for any indirect or business losses.
12.3 We are not liable for delays or failures caused by events outside our reasonable control, including delays by third-party suppliers of gemstones or materials.
13. General
13.1 Variation: we may update these Terms from time to time; the version in force at the date you approve your quotation will apply to your Commission.
13.2 Assignment: you may not transfer your rights or obligations under a Commission without our written consent; we may do so provided this does not reduce your protections as a consumer.
13.3 Severability: if any part of these Terms is found unenforceable, the rest will continue to apply.
13.4 Entire agreement: these Terms, together with your approved quotation, form the entire agreement between us for your Commission.
13.5 Governing law: these Terms are governed by English law, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
14. Complaints
14.1 If anything about your Commission or experience with us falls short, please contact us directly and we will do our best to put it right promptly and personally.
